Terms of Use
01 About the service
RetroMind is a real-time collaborative agile retrospective service, published by Thelis, a Belgian company with registered office at Rue des Salamandres 2, 5100 Naninne, Belgium (CBE: BE0893.178.572). The service is accessible at retromind.io.
02 Purpose
These Terms of Use define the conditions for using the RetroMind service and the rights and obligations of both parties.
03 Access and user account
Accessing the service requires creating an account with accurate, up-to-date information. Users are solely responsible for the confidentiality of their credentials. Any use of the service under your credentials is deemed to be performed by you. In case of compromise, contact Thelis immediately at contact@retromind.io.
04 Roles and permissions
RetroMind distinguishes four roles: Admin (organisation administration), Master (session facilitation), Participant (active contribution), Spectator (read-only access). The rights associated with each role are described in the online documentation.
05 Acceptable use
Users agree to use RetroMind in compliance with applicable laws and not to introduce unlawful content, infringe third-party rights, attempt to circumvent security measures, or use the service for fraudulent or anti-competitive purposes.
06 Service availability
Thelis endeavours to keep the service accessible 24/7. Scheduled maintenance interruptions may occur and will be notified in advance. Thelis is not liable for interruptions caused by third parties (hosting provider, network operator, force majeure).
07 Intellectual property
RetroMind, its features, interface and content are the exclusive property of Thelis, protected by intellectual property law. Data generated by users (cards, comments) remains their property. Thelis claims no rights over session content.
08 Liability
Thelis uses all reasonable means to ensure service quality. Its liability is limited to proven direct damages and capped at amounts paid during the last three months. Indirect damages, loss of business and commercial losses are expressly excluded.
09 Personal data
Personal data processing is governed by the Privacy Policy available at retromind.io/en/privacy/. By using RetroMind, users acknowledge having read this policy.
10 Changes to the Terms
Thelis reserves the right to modify these Terms. Users will be notified by email at least 30 days before changes take effect. Continued use of the service after that period constitutes acceptance of the new terms.
11 Governing law and disputes
These Terms are governed by Belgian law. In case of dispute, an amicable resolution will be sought first. Failing that, the matter will be brought before the competent Belgian courts.
